Withdraw from the online contract

From this page, you can exercise your right of withdrawal for a contract concluded online, where provided for by law and our conditions of sale.
Withdrawal may be exercised within 14 days of the day on which you—or a third party designated by you, other than the carrier—received the goods. In the case of goods delivered separately, the period begins on the day on which you—or a third party designated by you, other than the carrier—received the last item.
You do not need to provide a reason. After submitting the form, you will receive an email confirmation without undue delay, containing the details of your withdrawal declaration and the date and time of submission.

I hereby give notice that I withdraw from the sales contract concerning the goods indicated in this form.

I declare that I have read the privacy notice and understand that my data will be processed to manage this withdrawal request and related obligations.

Returns and complaints

Pursuant to art. 64 et seq. of the Consumer Code (Legislative Decree 2005/206), the customer has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty.

To exercise this right, the customer must send Fabrizi Family a communication within 14 days from the date of receipt of the goods.

This communication must be sent by certified email to the address fabrizifamily@pec.it

The email must be sent within the aforementioned 14-day period and followed by confirmation by registered letter with return receipt.

Fabrizi Family Customer Service, once the communication has been received, will inform the customer of the instructions on how to return the goods.

The right of withdrawal is subject to the following conditions:

The right applies to the purchased product in its entirety; it is not possible to exercise withdrawal only on part of the purchased product.
By law, the shipping costs relating to the return of the goods are borne by the customer.
The shipment, until certification of receipt in our warehouse, is under the complete responsibility of the customer.
Fabrizi Family is in no way responsible for damage or theft/loss of goods returned with uninsured shipments.
In the event of damage to the goods during transport, Fabrizi Family will notify the customer of the incident (within 5 working days), to allow them to file a claim against the courier and obtain any refund. In this case, the product will be made available to the customer for its return, while at the same time cancelling the withdrawal request.
In the case of shipments to non-European countries, the right applies only to defective or malfunctioning products.

Fabrizi Family will refund the customer the full amount already paid, within 30 days from the return of the goods, through the reversal procedure of the amount charged to the Credit Card or by Bank Transfer.
It will be the customer’s responsibility to provide the bank details on which to obtain the refund (ABI code – CAB – Current Account of the invoice holder).

The right of withdrawal is totally forfeited, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Fabrizi Family ascertains:

The absence of the outer packaging and/or wrapping containing the purchased product
Damage to the product for reasons other than its transport.

In the event of forfeiture of the right of withdrawal, Fabrizi Family will return the purchased goods to the sender, charging the same the shipping costs.

The refund is made using the same payment method on which the order was placed; in the case of bank transfers and cash on delivery, the user must indicate by email an IBAN on which to make the bank transfer.

Fabrizi Family intends to provide Customers with the possibility of replacing the Products purchased..

The Customer who is not fully satisfied must keep all documentation relating to the delivery and the Product itself in its original packaging and contact Fabrizi Family by sending an email to info@fabrizifamily.it.it or by calling the following number: (+39)0731.215159 / (+39)3533870750 (Mon-Fri 9:00 – 12:00). Fabrizi Family Customer Service will agree with the Customer on the collection of the Product.

Conformity defects

In the event of conformity defects in Products sold by Fabrizi Family, the Customer must immediately contact the email address info@fabrizifamily.it.it .

The sale of the Products is subject to the legal guarantees provided for by articles 129, 130 and 132 of the Consumer Code. The Customer has the right to have the conformity of the goods restored, free of charge, by repair or replacement, or to an appropriate price reduction or termination of the contract. The Customer forfeits these rights if they do not report the conformity defect to Fabrizi Family within two months from the date on which they discovered the defect.

Errors

The information relating to the Products provided through the Site is constantly updated; however, it is not possible to guarantee the complete absence of errors.

Fabrizi Family reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update the information at any time without prior notice.

Applicable law and competent court

The sales contract between the Customer and Fabrizi Family is deemed concluded in Italy and governed by Italian Law. For the resolution of civil and criminal disputes arising from the conclusion of this distance sales contract, if the Customer is a consumer, territorial jurisdiction is that of the court of reference of their municipality of residence or elected domicile if located in Italian territory; in all other cases, territorial jurisdiction is exclusively that of the Court of Jesi.
